By downloading, installing, and using Soul Pacer ("the app," "we," "our," or "the service"), you agree to be bound by these Terms of Use. If you do not agree to these terms, do not use the app. We reserve the right to modify these terms at any time. Your continued use of the app following changes constitutes your acceptance of the new terms.
Soul Pacer is an iOS fitness application that detects your walking, running, or cycling pace and matches music from your device's music library based on beats per minute (BPM). The app uses your device's motion sensors (accelerometer and pedometer) to calculate your cadence and selects songs with matching BPM to keep you in rhythm with your workout.

Pricing is in USD and may vary by region and currency. All prices are subject to change with 30 days written notice.
New subscribers receive a 7 calendar day free trial of the Premium subscription. During the free trial period, you have full access to all premium features at no charge. Your free trial begins on the date you initiate the trial and ends 7 days later at 11:59 PM Pacific Time.
If you do not cancel your free trial before the 7 day period ends, your subscription automatically converts to a paid subscription at the rate of the plan you selected (monthly or annual).
Your Soul Pacer subscription automatically renews at the end of each billing cycle unless you cancel it beforehand. When your free trial or current billing period ends, your Apple ID will be charged for the next period using the payment method associated with your Apple account.
Billing occurs within 24 hours before the end of your current period. For example, a monthly subscription renews approximately 30 days after purchase, and an annual subscription renews approximately 365 days after purchase.
All subscriptions are processed and managed through Apple's App Store. Soul Pacer does not collect, store, or process your payment information directly. Apple is responsible for billing and payment processing. Your payment is subject to Apple's payment terms, which are available on the App Store. By initiating a subscription, you authorize Apple to charge your App Store account for the subscription price.
You can cancel your subscription anytime. To cancel, go to your iPhone or iPad Settings, select your Apple ID, tap Subscriptions, select Soul Pacer, and tap Cancel Subscription. Cancellation takes effect immediately, and you will retain access to premium features through the end of your current billing period.
Apple's refund policy applies to Soul Pacer subscriptions. Generally, refunds for subscriptions are not available if you have already had access to the service for part of the billing period. If you believe you are entitled to a refund, contact Apple Support directly.
If you cancel during a free trial, your subscription ends immediately and you lose access to premium features. No refund is issued for canceling a free trial.

Soul Pacer is not responsible for the availability, quality, or licensing of music from these services. Use of Apple Music or Spotify requires an active subscription or account with those services.
Soul Pacer may integrate with Apple HealthKit to store your workout data. When you grant permission, the app can write the following data to Apple Health:
You control which data Soul Pacer can access through your device's Health app settings. You can revoke these permissions anytime in Settings > Health > Data Access & Devices > Soul Pacer.
Soul Pacer respects the privacy and security of your health data. Your HealthKit data is:
Soul Pacer does not collect health data without your explicit consent via iOS Health app permissions.
Soul Pacer is not a medical device and does not provide medical advice. It is designed for fitness and wellness purposes only. Do not use Soul Pacer as a substitute for medical advice or treatment from a qualified healthcare provider. If you have any health concerns or before starting a new exercise program, consult your doctor or a healthcare professional.
The information provided by Soul Pacer (pace, distance, calories, heart rate data from HealthKit) is for informational and fitness tracking purposes only. Always exercise at your own risk and listen to your body.

Soul Pacer and all of its content, including but not limited to software, design, graphics, text, coaching messages, and functionality, are the exclusive property of Ade Olabisi and protected by copyright and intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use Soul Pacer for personal, non-commercial fitness purposes only.
You may not reproduce, distribute, modify, adapt, translate, or create derivative works based on Soul Pacer without prior written permission. All rights not expressly granted are reserved.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, SOUL PACER AND ITS DEVELOPER ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
IN NO EVENT SHALL ADE OLABISI OR SOUL PACER BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOST DATA, OR LOST BUSINESS, ARISING FROM OR RELATING TO YOUR USE OF THE APP, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
Soul Pacer is provided without guarantees regarding accuracy, availability, or uninterrupted service. We are not responsible for any interruptions, errors, bugs, or outages. Your use of the app is at your own risk.
You agree to indemnify and hold harmless Ade Olabisi, Soul Pacer, and their respective officers, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from your violation of these terms, your use of the app, or any infringement of third-party rights related to your use.
We reserve the right to terminate your access to Soul Pacer at any time for any reason, including violation of these terms. Termination may be immediate and without notice. Upon termination, your license to use the app terminates, and you must cease all use immediately. Any data stored locally on your device remains yours, but deletion of the app results in loss of all locally stored data.
Soul Pacer is constantly evolving. We may modify, suspend, or discontinue any feature, function, or aspect of the service at any time. We are not obligated to provide notice of changes. Your continued use of the app constitutes acceptance of any modifications.
We may update these Terms of Use from time to time. When we make material changes, we will update the effective date at the top of this page. We encourage you to review these terms periodically. Your continued use of Soul Pacer following any changes constitutes your acceptance of the revised terms.
If any provision of these terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect to the maximum extent permitted by law.
These Terms of Use are governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law principles. Any legal action or proceeding relating to these terms or your use of Soul Pacer shall be subject to the exclusive jurisdiction of the state and federal courts located in California, and you consent to the personal jurisdiction of such courts.
